By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

By using the Site, you agree to comply with and be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. You are responsible for compliance with any local laws applicable to your use of the Site. If you do not agree with any part of these Terms, you must discontinue use of the Site immediately.

2. Eligibility

By using the Site, you represent and warrant that you are at least 18 years of age, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into these Terms.

3. Use of the Site

You agree to use the Site only for lawful purposes. You agree not to:

  • Attempt to gain unauthorized access to the Site, its servers, or any systems or networks connected to the Site;

4. Intellectual Property Rights

All content on the Site, including text, graphics, logos, templates, frameworks, course materials, downloadable resources, and the "from, Krystal Ivy" brand name and marks, are the property of From, Krystal Ivy LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without From, Krystal Ivy LLC's express written consent.

From, Krystal Ivy LLC's proprietary strategies, frameworks, systems, templates, and methodologies (including but not limited to those used in email marketing strategy, copywriting frameworks, and client delivery systems) remain the intellectual property of From, Krystal Ivy LLC at all times, whether referenced on this Site, taught through The Digital Cafe or the Inbox to Income Intensive, or applied in the course of client engagements. Purchase of a done-for-you service does not transfer ownership of the underlying methodology or process used to create the deliverable — only the specific, final deliverables agreed to in the applicable service agreement are transferred to the client, and only upon full payment. This provision does not limit or override any more specific IP terms set out in an executed client agreement, which will control for that engagement.

5. User-Generated Content

If you submit comments, testimonials, reviews, or other content to the Site ("Submissions"), you grant From, Krystal Ivy LLC a non-exclusive, royalty-free, worldwide right to use, reproduce, and display such Submissions in connection with operating and promoting the Site and our services, including as testimonials or case studies. You represent that you have the right to submit such content and that it does not infringe on any third party's rights. You may request removal of a Submission at any time by contacting us, and we will make reasonable efforts to accommodate that request.

6. Services and Client Agreements

These Terms govern use of the Site itself. From, Krystal Ivy LLC's paid services — including Newsletter Management, Welcome Package, E-Commerce Starter, Custom Email Template, the Inbox to Income Intensive, and any custom done-for-you engagement — are governed by a separately executed service agreement, proposal, or statement of work (each, a "Service Agreement") entered into between From, Krystal Ivy LLC and the client. In the event of any conflict between these Terms and an executed Service Agreement, the Service Agreement will control with respect to that engagement.

7. Purchases and Payments

If you purchase a product, service, or membership through the Site, you agree to pay all applicable fees. Payments are processed through secure third-party payment processors (such as Stripe or HoneyBook's payment infrastructure), and your use of those processors is subject to their own terms and privacy policies. From, Krystal Ivy LLC is not responsible for errors, outages, or data handling by third-party payment processors.

8. Refunds and Cancellations

All sales are final unless otherwise stated in writing or in an applicable Service Agreement. Refunds and cancellations for specific offers are governed by the refund terms provided at the point of sale or within the applicable Service Agreement, which are incorporated into these Terms by reference.

9. Digital Products and Memberships

Access to digital products and memberships, including The Digital Cafe, is governed by the specific terms provided at checkout. Memberships billed on a recurring basis will automatically renew at the then-current rate until cancelled. You may cancel your membership at any time through your account or membership platform settings, effective at the end of the current billing period. Except as required by law or expressly stated otherwise, payments already made are non-refundable, including for partial billing periods.

10. No Guarantee of Results

From, Krystal Ivy LLC provides email marketing strategy, copywriting, design, and related services. While we bring professional expertise and industry best practices to every engagement, we do not guarantee specific results, including but not limited to open rates, click rates, conversion rates, revenue, subscriber growth, or other business outcomes. Marketing performance depends on many factors outside our control, including your audience, offer, industry, timing, and platform behavior. Testimonials and case studies reflect individual results and are not a guarantee of similar outcomes for any other client.

11. Third-Party Platforms

Our services are frequently delivered using or integrated with third-party platforms, including but not limited to Klaviyo, Flodesk, Mailchimp, HoneyBook, Figma, Circle, and Google Workspace. From, Krystal Ivy LLC is not responsible for outages, bugs, pricing changes, feature changes, data loss, or policy changes made by these third-party platforms, and is not liable for any resulting delay, disruption, or damage to your business operations.

12. Artificial Intelligence Usage

From, Krystal Ivy LLC may use artificial intelligence (AI) tools as part of delivering our services, including for drafting, research, design assistance, and other production tasks. We are committed to consensual AI usage: if a project involves using AI in connection with someone's face, image, or likeness, we will ask for that person's comfort and consent before using their likeness in that way.

Please note that many platforms we work within (including email, design, and marketing platforms) have their own AI features and data-handling practices that are outside our control. While we take a consent-first approach to how we personally use AI with someone's likeness, we cannot guarantee how a third-party platform may process, train on, or otherwise use content — including photos or likenesses — once it is uploaded to that platform. We encourage clients to review the AI and data policies of any platform whose services they use directly.

13. Confidentiality

In the course of providing services, From, Krystal Ivy LLC may have access to client accounts, business data, and confidential information. From, Krystal Ivy LLC agrees to use such access solely for the purpose of performing the contracted services and will not disclose confidential client information to third parties except as required to deliver the services, as authorized by the client, or as required by law. More detailed confidentiality obligations may be set out in an applicable Service Agreement, which will control for that engagement.

14. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. From, Krystal Ivy LLC does not warrant that the Site will be uninterrupted, secure, or error-free.

15. Limitation of Liability

To the fullest extent permitted by law, in no event shall From, Krystal Ivy LLC, its members, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or related to your use of, or inability to use, the Site or our services, even if advised of the possibility of such damages. From, Krystal Ivy LLC's total aggregate liability for any claim arising from these Terms or an applicable Service Agreement shall not exceed the total amount paid by you to From, Krystal Ivy LLC in the twelve (12) months preceding the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless From, Krystal Ivy LLC, its members, officers, employees, and agents from any losses, liabilities, claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or inability to use the Site; (b) your violation of these Terms; (c) any content or Submissions you provide; or (d) your violation of any third-party right, including intellectual property or privacy rights.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in Illinois, and you consent to personal jurisdiction in those courts.

18. Privacy

Our collection and use of personal information in connection with the Site is described in our Privacy Policy, available at PRIVACY POLICY, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described in the Privacy Policy.
